The Malta Gaming Authority (MGA) is the administrative body accountable for all online and land-based gaming in Malta. As Malta’s ‘one-stop-shop’ for licensing, it is the MGA’s responsibility to encourage gaming in a safe environment and guarantee the uprightness of games and devices, while granting licenses to providers and building a regulated environment from which gaming activities, remote or otherwise, can take place.

Overview

Malta Gaming Services license can be characterized by the following:

TYPE 1 – Executives managing their own risk on repeated games such as casino-type games & online lotteries with risk

  • TYPE 2 – Executives managing their own risk on events based on a matchbook, for example, fixed odds betting
  • TYPE 3 – Operators supporting and promoting gaming from Malta & taking a share from advertising and/or abetting games such as P2P, poker networks and online lotteries without risk
  • TYPE 4 – skill games or controlled skill games the result of which is defined by the use of skill solely or predominantly by the practiced of skill, and rejects a sporting event
  • TYPE 1, 2, 3 on 4 – operators giving the same games as the initial Type operators but running on a third-party platform appropriately licensed by the MGA.

Company structure
  • Two shareholders (may be individuals or corporate)

Taxation

  • Gaming tax of 5% due is based on the gaming wealth created by the operators from end clients located in Malta
  • The tax on gaming devices obligatory in each and every tax period is calculated with relating to gaming machines used within gaming premises in the provision or conduct of the preferred Type of the license
  • The acquiescence contribution payable on qualifying exercises is determined with reference to the gaming revenue produced during the license period from the chosen Type gaming services
  • In Malta, any kind of services presented by gaming administrators are classified as exempt without credit under the VAT Act
  • Businesses listed in Malta are taxable at the rate of 35%, with exceptions

  • A notarized copy of valid passport
  • A notarized copy of birth certificate
  • Passport size photo
  • Certification of Good Character, declared by a law enforcing authority in the country of origin of the candidate
